Terms of Service

These Terms of Service ("Terms") set out the conditions for providing BOARDS.JP (the "Service") and for using it. By using the Service, users agree to these Terms.

Application

• These Terms apply to all relationships between users and us concerning use of the Service.
• We may establish other rules and provisions concerning the Service ("Additional Provisions"). Regardless of their names, those provisions form part of these Terms.
• If these Terms conflict with an Additional Provision, the Additional Provision takes precedence unless it states otherwise.

Prohibited activities

Users must not engage in the following activities.

• Violating these Terms.
• Violating the law or public order and morals.
• Causing discomfort or emotional harm to other users or third parties.
• Publishing false information or deceiving other users.
• Engaging in activities related to crime.
• Infringing copyright, trademarks, or other intellectual property rights contained in the Service.
• Disrupting or interfering with our servers or networks.
• Commercially exploiting information obtained through the Service.
• Interfering, or potentially interfering, with operation of the Service.
• Gaining or attempting unauthorized access.
• Collecting or storing personal information about other users.
• Impersonating another user.
• Directly or indirectly providing benefits to antisocial groups in connection with our services.
• Contacting users outside this Service, or advertising, soliciting, or selling other products or services to them, without their prior express consent.
• Adult content: Newly created BOARDS.JP boards and existing boards without the adult-content setting prohibit explicit sexual material and the publication, promotion, or linking of adult content in posts, linked pages, and attachments. A board that already had the adult-content setting when these Terms were revised may temporarily include adult posts until its individual review is complete. Even then, illegal content, exploitation of minors, uncensored images of genitalia, and excessive violence or gore are prohibited.
• Excessive violence and gore: Posting images, videos, writing, or other material depicting severe violence, bloodshed, internal organs, or similar gore is prohibited on every type of board.
• Users should avoid publishing content that causes discomfort, anxiety, or fear to others. Acts or images contrary to public order and morals are prohibited.
• Content that we determine is clearly offensive and promotes racial discrimination, prejudice, hatred, or physical harm against any group or individual.
• Content that uses a third party's information, such as their name, address, phone number, email address, or photograph, regardless of whether that person gave permission.
• Content that harasses a third party or instructs others to do so.
• Content associated with junk mail, chain letters, unsolicited messages, or spam.
• False or misleading content, or content that we determine encourages abuse, threats, obscenity, or defamation.
• Content that illegally or improperly copies copyright protected works or encourages this, including pirated software or music, links to pirated files, or instructions for bypassing copy protection.
• Content that includes nonexistent pages, password protected pages, or hidden pages or images.
• Content that exploits people under 18 or high school students in a sexual or violent manner, or seeks their personal information.
• Content that explains illegal activities such as manufacturing or buying illegal weapons, invading privacy, or creating computer viruses.
• Content that encourages improper drug use.
• Commercial or sales content, such as contests, lotteries, bartering, advertising, network marketing, or pyramid schemes, without our prior written permission.
• Violating our Third Party Service Policy Compliance rules (Japanese).
• Any other activity that we consider inappropriate.

Suspension of the Service

We may suspend or interrupt all or part of the Service without advance notice to users in any of the following circumstances:

• Maintenance or updates to the Service.
• Difficulty providing the Service due to an earthquake, lightning, fire, power outage, natural disaster, or other event beyond our control.
• Any other circumstance in which we determine that providing the Service is difficult.

Disclaimer of warranties and liability

• We do not warrant that the Service is free from factual or legal defects, including defects relating to safety, reliability, accuracy, completeness, effectiveness, suitability for a particular purpose, security, errors, bugs, or infringement of rights.
• We accept no liability for damages users incur through the Service. If a contract between a user and us concerning the Service, including these Terms, constitutes a consumer contract under Japan's Consumer Contract Act, this exclusion does not apply. Even then, we accept no liability for special damages arising from default or tort due to our negligence, excluding gross negligence, including where we or the user foresaw or could have foreseen the circumstances causing those damages.
• We accept no liability for transactions, communications, or disputes between users or between a user and a third party concerning the Service.

Further disclaimer

Unless we act intentionally or with gross negligence, we accept no liability for damages users incur in connection with use of the Service.

Governing law and jurisdiction

These Terms are governed by the laws of Japan. The courts having jurisdiction over the location of our principal office have exclusive jurisdiction over disputes concerning the Service.

Changes to the Service

We may change the Service or stop providing it without notifying users and accept no liability for damages arising from those changes.

Changes to these Terms

We may change these Terms without notifying users when we consider it necessary. A user who begins using the Service after a change is deemed to have agreed to the revised Terms.

Handling of personal information

We handle personal information acquired through use of the Service in accordance with our Privacy Policy.

Dispute resolution

• As a rule, users and we will first try to resolve disputes concerning the Service through discussion. Users must first contact our customer support team and explain the circumstances.
• Contact our customer support team through the dispute inquiry form (Japanese).
• If discussion cannot resolve the dispute, users may consult a consumer affairs center or a relevant arbitration body and may ultimately pursue legal action.
• Legal proceedings concerning the Service are subject to the exclusive agreed jurisdiction of the courts having jurisdiction over our principal office.

User responsibilities and our liability

• Users are responsible for complying with these Terms when using the Service.
• We accept no liability for damages caused by a user's violation of these Terms or improper use of the Service, except where we act intentionally or with gross negligence.
